Why is There a Philips CPAP Lawsuit?

After coming onto the market, users started complaining of black particles inside their machines. The company knew about these complaints for years but did not warn the public about the potential danger until April 2021, and they did not issue a recall until June 2021.

The FDA stated that a low rate of complaints caused Philips to look into their machines. They found that the PE-PUR foam used in their product design may degrade into particles. If they enter the device's air pathway, these particles may be ingested or inhaled by the CPAP user. The foam may also off-gas certain chemicals.

They also found that the breakdown of this PE-PUR foam may be worse when using unapproved cleaning methods or if the machine is exposed to an environment with high heat and humidity.
